  What Brexit means for RFID suppliers

  Regardless of the economic consequences that the UK faces due to a no-deal Brexit, RFID suppliers operating in the UK will be bound by the new regulations. It is important for all RFID stakeholders in the UK market to understand the new regulations, because violators will be subject to huge fines and other sanctions.

  At present, if the RFID device meets the requirements of the European Union Radio Equipment Directive (RED) and Low Voltage Directive (LVD), then the device can be sold in the UK. Some equipment is also restricted by the Hazardous Substances Directive (RoHS) and the Waste Electrical and Electronic Equipment Directive (WEEE). The European Union and the United Kingdom also require compliance with various harmonized standards.

  In the European Union, manufacturers, importers and distributors are responsible for ensuring that RFID devices comply with regulations. Before placing an RFID device on the EU market, the manufacturer must perform a conformity assessment procedure (CAP) to confirm that the device complies with the requirements of applicable directives and harmonized standards. There are currently three types of CAP, but they all involve compiling technical data, performing compliance testing, marking equipment (with CE marking, and in some cases with the identification number of an EU government agency), and compiling a compliance statement (DOC) to prove compliance and develop a compliance plan. Importers and distributors have their own qualification standards, but they are not so strict. Importers or distributors who sell RFID equipment under their own names or trademarks, as well as importers or distributors who carry out technological transformation of the equipment, will be classified as manufacturers who conduct marketing activities in the EU market.

  According to data from the British Ministry of Commerce, Energy and Industrial Strategy (BEIS), RFID devices working in the 865~868MHz frequency band with a power of up to 2 watts, and working in the 915~921MHz frequency band with a power of up to 4 watts, will all be in the "new legislative framework" Under supervision. For these products, the following points will apply to RFID equipment suppliers who sell their products in the UK after the UK has no agreement to leave the European Union:

  1. The equipment that meets EU standards that the EU put on the UK market before Brexit will remain in compliance with EU standards after Brexit.

  2. RFID devices that comply with EU requirements and carry the CE mark can be put on the UK market for the first time within 18 months after the Brexit date.

  3. After the end of the 18-month transition period, new products placed on the UK market will need to meet the UK’s specific radio frequency equipment regulations, but the EU harmonized standards will continue to be effective in the UK as “designated standards” to maintain the relationship between the UK and the EU. Single standard mode.

  4. After the 18-month transition period is over, all RFID devices entering the UK market after Brexit will need to carry a new label, the UKCA logo.

  5. After Brexit, the legal obligations of RFID manufacturers will remain basically unchanged.

  6. Any entity company that brings manufactured RFID equipment from the EU to the UK for placing on the market will be classified as an importer (for example, if you want to continue to sell its products in the EU, the EU entity company as a distributor will now become Importer). All importers of RFID equipment after Brexit must follow the following actions:

  ① Mark the company name, registered trade name or trademark and contact address on the product;

  ②Ensure that all equipment imported into the UK meets the CAP standard;

  ③Ensure that the equipment has the correct consistency mark;

  ④ Confirm that the manufacturer has formulated the correct technical documents and meets its labeling requirements;

  ⑤Be vigilant about unqualified equipment. If there is reason to believe that it does not meet the relevant regulatory requirements, it shall not be imported into the UK;

  ⑥ Supervise whether the products on the market meet the requirements of laws and regulations.
